Welcome to Zero Dark. These Terms of Service (“Terms”) govern your access to and use of all services, programs, events, websites, and content operated by Zero Dark Pty Ltd (“Zero Dark”, “we”, “us”, or “our”), a business registered in Brisbane, Queensland, Australia.

By accessing or using our website, services, or content, you agree to be bound by these Terms. If you do not agree, you must not access or use our services.

1. Use of Services

You agree to use Zero Dark’s website and services for lawful purposes only. You must not:

Zero Dark reserves the right to refuse service, terminate accounts, or restrict access if we believe a user has violated these Terms.

All content provided by Zero Dark—including but not limited to course materials, graphics, logos, text, and video content—is protected by copyright, trademark, and other intellectual property laws under the Copyright Act 1968 (Cth).

You may not copy, distribute, modify, or use our content without our express written consent, except where otherwise permitted under fair use provisions of Australian law.

3. Purchases & Payments

All purchases made through Zero Dark’s website are final, unless otherwise required by the Australian Consumer Law (ACL).

We accept major payment methods via secure third-party providers. You agree to provide accurate and complete billing information.

If you experience any issues with payments or transactions, please contact us at info@zerodark.com.au within 7 days of the charge.

4. Cancellations & Refunds

Our refund and cancellation policy is compliant with the Competition and Consumer Act 2010 (Cth). We offer refunds or rescheduling in cases where:

A service was not provided as advertised,
The service was not delivered within a reasonable time,
Or as otherwise required under the ACL.

No refunds will be issued for change of mind, non-attendance at events, or dissatisfaction arising from a failure to engage with course material.

5. Disclaimers

All services and content are provided “as is” and “as available.” Zero Dark does not guarantee specific results from our leadership programs, bootcamps, or online content.

While our content is grounded in real-world leadership experience, it should not be construed as legal, financial, or psychological advice.

You participate in events like APEX at your own risk. Physical challenges and outdoor environments come with inherent risks, and you acknowledge and accept responsibility for your participation.

6. Limitation of Liability

To the maximum extent permitted under Australian law, Zero Dark is not liable for any direct, indirect, incidental, or consequential damages resulting from your use of our services.

This includes (but is not limited to) loss of data, business interruption, injury during physical events, or reputational damage.

Nothing in these Terms excludes any consumer rights under the ACL, which cannot be excluded or limited by contract.

7. Privacy

Your privacy is important to us. Our use of personal information is governed by our Privacy Policy, which complies with the Privacy Act 1988 (Cth).

We will never share your data with third parties without your consent, unless legally required to do so.

8. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising in relation to these Terms shall be resolved in the courts of Brisbane, Queensland.

We reserve the right to update these Terms at any time. When we do, we will revise the “Effective Date” at the top of this page. Continued use of our services after changes are made constitutes acceptance of the revised Terms.
